Driver Responsibility for Child Passengers

Published by Waterstone Law Group

We all know that we should be wearing seat belts when traveling in a moving vehicle, and that children are no exception.

In his recent blog post, Daniel Sorensen, discusses drivers’ responsibility to their passengers, and particularly in ensuring that child passengers are appropriately secured in a motor vehicle.  He highlights a surprisingly recent case where the driver was operating a pick-up truck with four children in the open bed of the pick-up truck. The children were (obviously) not wearing seat belts, and sadly one stood up and fell out on to the road. The child was severely injured as a result of the fall.

How do you think the Court apportioned responsibility for such an injury?  You can read more about the case here.
